Welcome to C Roberts Music Lessons! By enrolling in lessons, you agree to the following Terms of Service (TOS), which define our rights, responsibilities, and policies. Please read this document carefully before booking lessons.

1. Lesson Payments & Refunds
Payment Policy
- All lessons must be prepaid or paid immediately after the lesson per business policy.
- Payments can be made via Stripe, Zelle, Venmo, cash, check, or credit card (4% transaction fee applies).
- Lesson management, scheduling, and payment processing are handled via My Music Staff (MMS) to streamline administrative processes.

Refund Policy
- All sales are final. Refunds are only granted if a student permanently discontinues lessons and has prepaid, unused lessons remaining.
- Auto-renewal payments are non-refundable for the current billing cycle. Cancellation stops future charges but does not issue a refund for the remainder of the active cycle.
- Force Majeure Exception: Refunds or rescheduling may be granted on a case-by-case basis for verified emergencies such as serious illness, natural disasters, or other uncontrollable circumstances.
- Trial lessons follow the same payment & refund rules unless a promotional offer specifies otherwise.
- Unpaid balances beyond two weeks will result in a temporary restriction from booking until the balance is cleared.

Payment Options
- Recurring Lessons: Auto-renewal is offered only as a convenience for ongoing lessons and does not constitute a subscription commitment.
- One-Time Purchase (OTP): Pay per individual lesson.

2. Cancellations & Rescheduling
Student Cancellations
- Students must reschedule at least 24 hours in advance to avoid forfeiting the lesson.
- No-shows and late cancellations (less than 24 hours’ notice) result in forfeiture of the full lesson fee, except in cases of force majeure (see Section 7).
Instructor Cancellations
- If the instructor cancels a lesson, students may reschedule or receive a refund, with rescheduling being the default option.

3. Student & Parent Code of Conduct
Respect & Engagement
- Students and parents must maintain a respectful, positive, and professional learning environment.
- Students are expected to actively participate, come prepared, and follow lesson guidelines.
Parental Involvement
- Parents are welcome to observe occasionally, but frequent interruptions, coaching, or directing during lessons are discouraged.
- If needed, the instructor may request adjustments, such as limited observation, waiting outside, or post-lesson discussions to ensure the best learning experience.
Behavior Expectations
- Respectful Conduct: Students and parents must treat the instructor and lesson environment with courtesy.
- Disruptive Behavior: Any conduct deemed inappropriate, offensive, or disruptive may result in lesson termination without a refund.
Final Note
C Roberts Music Lessons reserves the right to terminate lessons if behavior expectations are not met, ensuring a positive experience for all students..
4. Legal & Parental Responsibility
Parental Responsibility
For students under 18, a Parent or Legal Guardian acknowledges the following responsibilities:
- The parent/guardian is financially responsible for all lesson fees, cancellations, and rescheduling.
- The parent/guardian understands and agrees to all terms outlined in the Refund & Cancellation Policies.
- C Roberts Music Lessons is not liable for injuries, damages, or lost items during lessons.
- The instructor reserves the right to discontinue lessons if student behavior is disruptive.
- Mediation is required before legal proceedings, and the parent/guardian assumes legal fee responsibility if a judgment is held against them.
By enrolling a minor in lessons, the parent/guardian agrees to these terms.
5. Intellectual Property & Lesson Materials
Ownership of Materials:
- All lesson materials, sheet music, exercises, and resources provided by C Roberts Music Lessons are copyrighted and for personal use only.
- Students may not distribute, resell, or share lesson materials without written permission.
Recording & Social Media Use:
- Students may record their own lessons for personal review.
- Students may post lesson clips under five minutes to social media but must credit C Roberts Music Lessons.
- Full-lesson recordings may not be distributed or uploaded online.

6. Dispute Resolution & Legal Compliance
Mediation First Policy:
- In the event of a dispute, mediation is required before any legal action can be taken.
- If mediation fails, legal proceedings must be filed in Los Angeles County, California, under U.S. law.
Jurisdiction:
- These Terms of Service are governed by the laws of the State of California and the United States.

7. Liability Indemnity
Assumption of Risk:
By enrolling in lessons, students (or parents/guardians if under 18) assume all risks associated with music instruction, including but not limited to:
Instrument-Related Injuries – Repetitive strain, hand/wrist fatigue, drumstick impact, vocal strain.
Equipment Damage – Personal instruments, lesson equipment, or amplification devices.
Hearing Concerns – High-volume instruments such as drums may cause hearing fatigue. Though we try to use low volume instruments for drums, they are loud by nature. Hearing protection is recommended.
Limitation of Liability:
- C Roberts Music Lessons is not responsible for injuries, damages, or losses incurred during or as a result of lessons.
- Parents/guardians assume full responsibility for their child’s safety and conduct during lessons.
- By participating in lessons, students (or their guardians) agree to waive, release, and hold harmless C Roberts Music Lessons and its instructors from any and all claims arising from lesson participation, including but not limited to injuries, loss of personal property, or dissatisfaction with lesson outcomes.

8. Force Majeure Clause
Definition:
A force majeure event is an unforeseen event beyond reasonable control that prevents lessons from taking place, such as:
Natural Disasters (earthquakes, wildfires, floods)
Health Emergencies (pandemics, student illness)
Government Restrictions (lockdowns, travel bans)
Policy for Force Majeure Events:
- Lessons will be rescheduled whenever possible.
- If rescheduling is not feasible, a credit for future lessons may be issued.
- Refunds will be considered on a case-by-case basis.

9. Right to Modify Terms
Policy Updates:
- C Roberts Music Lessons reserves the right to update these Terms of Service at any time.
- Any modifications will be communicated with reasonable notice via email or website updates.
- Continued use of services after updates implies acceptance of the revised terms.

Final Acknowledgment
By booking and attending lessons, you acknowledge that you have read, understood, and agreed to these Terms of Service.
