This Liability Waiver outlines the risks associated with music instruction and the limitations of liability for C Roberts Music Lessons. By enrolling in lessons, students (or their parents/guardians if under 18) acknowledge and accept these risks.

1. Assumption of Risk & Student Responsibility

Acknowledgment of Risk:

Music instruction may involve physical activity, sound exposure, and use of musical instruments and equipment. By participating in lessons, students (or their legal guardians if under 18) acknowledge and assume responsibility for the following risks:

Instrument-Related Injuries – Repetitive strain, hand/wrist fatigue, drumstick impact, vocal strain, or other playing-related injuries.
Hearing Protection Advisory – Exposure to loud instruments (e.g., drums, amplifiers) may cause hearing fatigue or damage. Hearing protection is highly recommended.
Damage to Personal Instruments or Equipment
– C Roberts Music Lessons is not responsible for damage to student-owned instruments, gear, or accessories during lessons.
Loss of Personal Belongings – C Roberts Music Lessons is not liable for lost or stolen items but will make reasonable efforts to locate and secure misplaced belongings.

Student Equipment Usage:

  • Students who use instructor-owned equipment (e.g., drum kits, amplifiers) do so at their own risk.
  • Expected wear and tear is acceptable, but students who excessively damage or destroy equipment due to misuse may be required to cover repair or replacement costs.

Group Class Equipment Requirement:

For group classes, students may be required to bring their own instruments or equipment as specified in the class description. It is the student’s responsibility to ensure they bring the necessary materials. C Roberts Music Lessons is not responsible for damage to or loss of student-owned equipment during group classes.


2. Parental Responsibility for Minors

Parental Acknowledgment:

For students under 18, parents/guardians acknowledge full responsibility for their child’s:
Behavior and conduct during lessons.
Safety while traveling to and from lessons.
Understanding of lesson expectations, including hearing protection recommendations.

If stricter parental liability terms are needed in the future, C Roberts Music Lessons may require a formal teacher-student contract.


3. Off-Site & Virtual Lesson Liability

Scope of Liability Coverage:

This waiver applies to all lessons, regardless of location, including:

  • In-person lessons at the instructor’s studio or another teaching space.
  • In-home lessons at the student’s residence.
  • Outdoor or public space lessons (if applicable).
  • Virtual lessons conducted online.

Student Responsibility in Virtual Lessons:

  • Students must ensure their lesson area is safe and free of tripping hazards.
  • C Roberts Music Lessons is not responsible for injuries caused by student setup issues (e.g., tripping over cables, falling equipment, etc.).

4. Limitations of Liability & Indemnification

General Liability Limitation:

C Roberts Music Lessons is not responsible for injuries, damages, or losses incurred during or as a result of lessons. By participating, students and parents agree to waive, release, and hold harmless C Roberts Music Lessons and its instructors from any and all claims, including but not limited to:
Personal injuries sustained during lessons.
Damage to or loss of personal instruments or belongings.
Hearing-related concerns due to high-volume instruments.

Excessive Wear & Equipment Misuse:

  • Normal wear on instructor-owned equipment is expected.
  • Students who intentionally or negligently damage instructor equipment may be required to pay for repairs or replacements.

Indemnification Clause:

Students (or parents/guardians, if applicable) agree to indemnify and hold harmless C Roberts Music Lessons from any legal claims, disputes, or damages arising from participation in lessons.


5. Dispute Resolution & Legal Compliance

Mediation First Policy:

  • In the event of a dispute related to liability, mediation is required before any legal action can be taken.

Jurisdiction:

  • Any legal claims related to liability, injury, or damages must be filed in Los Angeles County, California under U.S. law.

6. Right to Modify Policy

Policy Updates:

  • C Roberts Music Lessons reserves the right to update this Liability Waiver at any time.
  • Any modifications will be communicated with reasonable notice via email or website updates.
  • Continued participation in lessons implies acceptance of the revised waiver.

Final Acknowledgment

By booking and attending lessons, students (or their guardians, if under 18) acknowledge that they have read, understood, and agreed to this Liability Waiver.
