Force Majeure Policy

This Force Majeure Policy outlines the conditions under which lessons may be rescheduled, refunded, or otherwise adjusted due to extraordinary, unforeseen events beyond the control of students, parents, or the instructor. By booking lessons, students and parents acknowledge and agree to this policy.

1. Definition of Force Majeure

A force majeure event is an unforeseen, extraordinary event that prevents lessons from taking place. Examples include but are not limited to:

  • Natural Disasters: Earthquakes, wildfires, floods, hurricanes, severe storms.
  • Health Emergencies: Pandemics, student illness requiring hospitalization, medical emergencies.
  • Government Restrictions: Lockdowns, travel bans, mandatory evacuations, martial law.
  • Unforeseen Major Life Events: Car accidents, sudden hospitalization, death in the immediate family.
  • Infrastructure Failures: Major power outages, internet failures affecting virtual lessons.

2. Student-Affected Force Majeure Events

Rescheduling Due to Force Majeure

  • Students impacted by a force majeure event may reschedule their lesson without penalty.
  • Rescheduled lessons must be taken within 30 days of the original lesson date unless ongoing circumstances prevent it, in which case further review is required.
  • If force majeure-related cancellations become recurring, documentation (e.g., doctor’s note, police report) may be required for further rescheduling.

Refunds Due to Force Majeure

  • If a lesson cannot be rescheduled due to a long-term or continuing force majeure event, students may receive a lesson credit for future use.
  • Refunds for lessons missed due to a force majeure event will be considered on a case-by-case basis and are subject to C Roberts Music Lessons’ standard processing fees.
  • Full lesson package refunds due to force majeure are only granted in extreme cases where the student must permanently discontinue lessons.

3. Instructor-Affected Force Majeure Events

Rescheduling Instructor-Canceled Lessons Due to Force Majeure

  • If the instructor is affected by a force majeure event, the lesson will be rescheduled at the earliest convenience.
  • If a long-term issue prevents the instructor from teaching, students will be given the option of lesson credits or refunds for unused lessons.

Refunds Due to Instructor-Caused Force Majeure

  • If the instructor is unable to provide lessons for an extended period and rescheduling is not feasible, students may request a pro-rated refund for unused lessons.

4. Documentation Requirements

  • C Roberts Music Lessons reserves the right to request reasonable proof of a force majeure event if cancellations become frequent or prolonged.
  • Examples of acceptable documentation include:
    • Doctor’s note for medical-related cancellations.
    • Proof of government restriction orders for travel bans or lockdowns.
    • Police report or official incident documentation for accidents or emergencies.

5. Right to Modify Policy

  • C Roberts Music Lessons reserves the right to update this Force Majeure Policy at any time.
  • Any modifications will be communicated with reasonable notice via email or website updates.
  • Continued participation in lessons implies acceptance of the revised terms.

Final Acknowledgment

By booking and attending lessons, students (or their parents/guardians, if applicable) acknowledge and agree to the Force Majeure Policy as outlined above.
